摘　　要： 保安处分制度是近现代法学领域重要的刑法制度。本文立足于中国的法制与现实,并结合最新的立法动态论证了保安处分制度在中国适用的必要性和可能性。首先,概述保安处分的理论蕴含和特征。其次,在论文的主体引入对中国特色刑罚结构的体系化分析,解读中国刑罚结构的理论基础和发展方向,并提出保安处分对于中国刑罚结构的重要意义。最后,剖析保安处分在中国适用的瓶颈及其制度建构应当把握的层次。阐明目前我国适用保安处分制度需要缕清的问题,以期达到保安处分在我国适用的效益最大化。 Security Penalty System is an important criminal law system in the field of modern law. This paper isbased on the Chinese reality and legal status and demonstrates the necessity and possibility of the application of thesystem in China. First of all,extract the theory and core characteristics of the system. Then,in the paper the maincontent,this paper focuses on the Chinese penalty structure,analyzes its theoretical foundation and developingdirection,and puts forward the significance of security measures for Chinese sentence structure. Last but not least,propose some specific solutions and system constructions for the shackles of the security measures. In a word,thispaper is based on the theoretical and practical analysis of our country's application of Security Penalty System at thepresent,and in order to maximize the benefit of the system in our legislation.
