摘　　要： 我国法律对于主张合同无效的权利没有作出时间上的限制 ,本文从无效合同及诉讼时效制度功能权衡、请求确认合同无效的权利性质及其与诉讼时效的适用范围的关系来论证了请求法院确认合同无效的权利应受诉讼时效的限制。 There is no time limitation to the right of claiming a contract invalid in our laws. By discussing the invalid contract and the function of system of limitation of actions, the character of the right of claiming a contract invalid and the applicability of the limitation of actions, the thesis proves the limits to the limitation of actions in applying to the court for affirming a contract invalid.
