摘　　要： 随着生态环境问题的日益凸显,政府作为我国环境保护事业的主要责任主体,为确保国家生态安全,维护生态法律秩序,必须发挥主导作用。新环保法实施已届满一年,尽管"一部长牙齿的法律"的形象已深入人心,但在法制变迁的图景之下,亦面临着诸多挑战,正有待社会实践进一步检验其实效,而这又与政府环境责任法制化的实现路径密不可分。基于结构性法制构成要素的视角审视政府环境责任法制化的实现路径,可归结为依法界定中央政府的环境职责与地方(乡镇)政府环境职权、依法规定环境质量责任标准及政府环境责任属性等几个方面。 The ecological and environmental problems are becoming increasingly prominent, as the main subject of liability for the environmental protection in our country, to ensure the national ecological security, maintain ecological legal order, the government must play a leading role. Implementation of the new environmental law has expired a year, although the image of law with teeth has been deeply rooted in the minds of the people, but under the transition of legal system, it is also facing many challenges, it needs social practice to verify the effectiveness and it is closely related to the realization of government envi- ronmental responsibility. Based on the perspective of constituting elements of the structural law to review the legalization meth od of governmental responsibility, it can be concluded as legal definition of central government and local government＇s environmental responsibility, legal regulation of liability standard of environmental quality, character of government environmental responsibility and other aspects.
