摘　　要： 单位毒品累犯是刑法理论与司法实践中亟待解决的现实难题 ,我国刑法界迄今为止对之尚缺乏应有的关注。其实 ,新刑法第 30、6 5、10 1、35 6条等有关条文都可作为单位毒品累犯存在的刑法根据。根据新刑法的有关规定 ,单位毒品累犯不仅有单位毒品普通累犯 ,而且有单位毒品特别累犯。不论是前者还是后者 ,在其认定的刑法适用上都必须符合有关犯罪、刑罚与时间三个方面的限制条件 。 Unit recidivists about drugs have been the real difficult problems which need urgently solving in the criminal theory and in the judicial practice, but up to now, there is still lack of the due attention to them in the criminal field of our country. In fact ,the provisions of the relevant articles of Article 30, 65, 101, 356 and so on may all be taken as the bases of the Criminal Law of the unit recidivists about drugs not On the basis of the provisions of the relevant articles mentioned above, unit recidivists about drugs only have the common recidivist of a unit about drugs, but also have the special recidivist of a unit about drugs, but regardless of the former or the latter, it must accord with the definite conditions of the three aspects on the crimes, the penalties and the time on the application of the Criminal Law of its fixing, and it must follow the principle of the being given a heavier punishment on the application of the Criminal Law of its punishing.
