摘　　要： 新刑法第 30条是对我国以往单位犯罪刑事立法的一个重要总结 ,其价值在于 :明确提出“单位犯罪”概念 ,有助于统一认识 ;强调单位犯罪的法定性 ,体现了罪刑法定原则 ;提供认定单位犯罪的总则性标准 ,有助于遏制单位犯罪 ;肯定单位犯罪 ,符合世界刑法发展的潮流。为充分发挥其功能 ,科学把握其精神 ,正确指导司法实践 。 Artcle 30 of the new Criminal Law is an important summing?up to the past experience of the criminal legislation of the crimes committed by a unit in our country.Its values lie in:(1) explicitly proposing the concept to the crimes committed by a unit,being helpful to unifying the recognition;(2) stressing legality of the crimes committed by a unit,showing the principle of nullum crimen sine lege;(3) providing the standard with the nature of the general provisions verificating the crimes committed by a unit,being helpful to deterring the crimes committed by a unit;and(4) being positive about the crimes committed by a unit,complying with the developmental tide of the criminal laws in the world.In order to make full use of its function,to scientifically grasp its spirit,and to correctly guide the judicial practice,it is surely necessary to deeply and rationally analyse the implication of its standard.
