摘　　要： 制定中国物权法是当前中国完善民事立法的重要步骤之一。物权法的基本原则与精神是合法财产一体保护；在物权变动规则中，应确立物权变动与原因行为的区分原则，并重构一个统一的、与行政管理权脱钩的不动产登记制度；物权立法要进一步完善用益物权体系，建立我国的让与担保、浮动担保及典权制度，增加交易、融资途径，促进经济发展。 The author holds that it is a significant procedure to make the law of real right in China for improving civil legislation． The basic principle and essence of the law of real right is an integrated protection of lawful property which needs a registration system of immovable property featuring a uniform and irrelative to the administration right． In sum the legislation of real right requires improving usufructuary real right system in order to serve the economic development．
