摘　　要： 通过对美国、英国、德国等欧美国家大规模侵权责任保险赔偿制度实践进行比较发现,美国法院在大规模侵权领域的司法判决先例与责任保险制度对其他国家有着重要影响。法律制度变化、责任索赔增长率的不断上升、大规模侵权在时间与空间上的累积以及广泛影响,推动了大规模侵权责任保险经营模式、承保技术的变革与创新。借鉴发达国家的经验并结合我国实际,从中获得对影响我国大规模侵权责任保险制度构建并推进其运用因素的认知,使大规模侵权责任保险制度在实施中得以不断完善。 Practice of mass torts Lability insurance compensation system in European and American countries such as the United States, Britain, and Germany is analyzed and compared. It finds that legal precedents of mass torts in U. S. courts as well as liability insurance system influence other counmes. The legal system changes, the increasing liability claims, the accumulation of mass torts in time and space and its widespread influence, promotes the changes and innovation of business model and insurance techniques in mass torts liabil- ity insurance. Learning experiences from these countries and the reality of our country, we have the perception of impact factors on constructing and promoting mass torts liability insurance system in our country, make con- siderable development of mass torts liability insurance business, and improve mass torts liability insurance sys- tem during implementation.
