摘 要: 行政参与是实现现代行政民主化、规范化的重要途径之一,通过公众参与可以达到提升行政过程民主性和合法性的目的。行政规则是指行政主体针对内部事务发布的各项规范性文件的总称,原则上在不对行政相对人权利义务产生影响的情况下,其制定与执行并不需要行政参与的加入。但随着行政规则调整范围和实际效用的不断扩大,实践中有些行政规则也在事实上具备了外部效力,对于这部分效力外化的行政规则,在制定过程中就有必要考虑引入公众参与来提升规则制定的正当性和科学性。但由于行政规则种类繁多、功能多元,需要进一步从正反两面考量参与的程度与方式,以求达到最有效的参与结果。 The public participation in the administrative process is one of the important ways of realizing the democratization and normalization of modern administration. Public participation can help to achieve the goal of enhancing the democracy and legacy of administrative process. Administrative rule is the general term for all the normative documents issued by administrative subject as to internal affairs. In principle, its making and implementation does not need the participation of administration, if it has no effect on the right and obligation of administrative counterpart. However, with the continuous expansion of the regulation range and practical utility, in practice, some administrative rules have actually possessed external effect. For these effect-externalized administrative rules, it is necessary to introduce the participation of the public in the process of rule-making to enhance the justifiability and scientificity. But due to the various kinds and diversified functions of administrative rules, we need to further examine the degree and ways of participation from both sides, so as to achieve the most effective result of participation.
