摘 要: 线人协议是明确线人与侦查机关双方权利义务的合同。由于我国对线人的管理与使用缺乏完善的法律规范,实践中出现的问题很多。线人与侦查机关实际上可能形成三种合同关系:悬赏合同、劳务合同和劳动合同。在线人协议的内容确定上,线人的刑事责任豁免能否写入协议是一个关键性问题。对线人与侦查机关违约行为及其救济,追究违约责任的方式与一般的协议应有所区别。 Informant agreement is a kind of contract of confirming the rights and obligations between the informant and the investigative organization. Because of the lack of sound legal norms for the proper management of the informer, lots of problems arise in practice. In fact, there are three kinds of contractual relationships between informants and investigative organization:reward contract, work contract and labor contract. In the con- tent of the Informant agreement, it is a critical issue whether the informant' s immunity from criminal responsi- bility will become effective or not. At the same time, the nonperformance by the informant and its remedies should be different with the normal agreements.
