摘 要: 随着时代的快速发展,人们生活水平的不断提高,私人汽车迅速增长。但是在有限的土地资源中,停车成为了一个困难的问题,究竟地下车位是小区的配套设施,应当归全体业主所有还是属于开发商,成为现在热议的一个话题。但是我国《物权法》的相关规定过于简单,难以有效地解决我国车库车位的相关问题,所以,如何合理的规定小区车库车位成为了一个亟待解决的难题。 With the development of the world, People' s living conditions have improved a lot and the development of pri- vate car in china is growing fast. However, there are a lot of problems, such as, how can we stop our cars on the limited land resources. As a result, whether the underground parking space belongs to all of owners or developer has became a hot topic. But, the rules of real fight law of China are so simple that how we can rule the rights of underground parking space becomes a hard problem.
