摘　　要： 治疗用药豁免(Therapeutic Use Exemption,TUE)规则属于世界反兴奋剂机制下的5项国际标准之一。TUE的申请涉及当运动员因服用治疗性药物导致兴奋剂检测结果呈阳性时,是否能够免除处罚的问题。该规则的产生源于实践案例:人们意识到,只要存在违禁物质就处罚运动员是苛刻的,某些疾病的用药必然导致兴奋剂物质存于运动员体内,但并无益于提高运动员赛事能力。通过对CAS(体育仲裁院)公开的首次涉及治疗用药豁免规则案例的叙述,分析其产生的理论逻辑,在肯定其提出的意义之后,对其实质性内容进行批判,以期得到进一步完善。 Therapeutic Use Exemptions （TUE） is one of the five international standards under the World Anti-Doping Agency （WADA）. TUE specifies whether players can be exempted from punishment when they have tested positive for doping test for taking therapeutic drugs. People become aware of that in practice, resorting to punishment the minute prohibited substances are spotted is too hasty and rather unfair since certain therapeutic drugs inevitably leave doping substances in the body while not necessarily bringing out exceeding performance. Therefore, TUE rule came into being. This article aims to in- troduce the first case of the Therapeutic Use Exemption （TUE） in CAS and analyze TUE criteria to further the improvement of the anti-doping system.
