摘　　要： 国家重视体育社团功能作用和现行体育社团立法长期滞后是我国体育社团立法修改的立法背景。依法治体、体制改革加快、民间参与管理、政府鼓励、问题丛生是我国体育社团立法修改的立法条件。我国已经建立起以宪法为龙头的体育社团立法体系,并且具有行政立法主导、配套立法缺位、回避立法难题等立法特点。我国体育社团立法正在面临体育社团改革挑战和立法体系内部冲突的立法困境。未来我国《体育法》体育社团立法修改,应当保持专章立法体例不变,明确体育社团法律性质,保障体育社团独立地位,明确体育社团管理职权,加大体育社团扶持力度。 The facts that the state values sports community functions and current sports community legislation lags behind for a long time are the legislative bac legislation modification. Ruling sports by law, system reform kground of Chinese sports community acceleration, private participation management ,government encouragement and many problems of sports community are the legislative conditions of Chinese sports community legislation and modification. China has set up a legislation system with the constitution as the leading factor of sports community, whose characteristics are with the administrative legislation as a leading role, supporting legislation vacancy, avoiding legislative problem. Chinese sports community legislation is faced with challenge of sports community reform and internal conflict of legislation system. The legislative modification of Sports law of the PRC on sports community should retain the independent chapter, define the legal nature of sports organiza- tions, guarantee sports organizations＇ independent status, define the management power of sports or- ganizations, and strengthen the support for sports organizations.
