摘 要: 随着冷战的结束,联合国安理会开始在维护世界和平与安全方面发挥越来越积极的作用。但与此同时,其权力的行使又在许多方面存在超越《联合国宪章》及国际法规定的嫌疑。那么,像安理会这样肩负着如此重要职责的国际机关,其权力是否需要受到国际法的限制呢?通过对《联合国宪章》相关条文的分析,可以看出,安理会的权力虽然具有一定的优先性,但仍然是有其法律界限的,它需受到两类国际法规则即《联合国宪章》本身的规定和国际强行法规则的约束。因此,安理会权力仍具备"有限性"特征。 Since the end of the Cold War,the Security Council has played a rather active role in using its enforcement powers to maintain international peace and security. But at the same time, there is a doubt whether some enforcement actions were beyond stipulations of the UN Charter and international law. Then there arises a question should the Security Council,one of the main organs of the UN,abide by the international law? Upon analysis of relevant articles of the UN Charter,we can see that de- spite its relevant priority of power, the Security Council is still restrained by two categories of laws:the UN Charter and Jus Cogens in international laws. Therefore,powers of the Security Council are legally limited.
