摘 要: 金融创新加剧了金融消费者与金融机构之间地位的不平等,造成了二者之间权利义务的失衡。纠正这种失衡,需要强化金融消费者保护理念,进行身份调整与角色嬗变,实施偏重保护,即以金融消费者的隐私权、知情权与受教育权以及金融机构保密义务及说明义务为重点平衡双方权利义务;同时进行统合主义的金融监管改革,建立统一的金融消费者保护机构;以金融ADR为重点构建多元金融纠纷解决机制;完善金融市场约束机制,防范金融消费者保护可能引发的道德风险。 Financial innovation reinforces the imbalance of status between financial customers and financial institutions, and leads to the imbalance of rights and obligations. Rectifying this imbalance must consolidate the conception of the protection of financial customers, adjust the status and roles, and balance the fights and obligations of both sides focusing on privacy, right to information, educational right and confidential obli- gation, illustrative obligation of financial customers. Meanwhile, financial regulation reform must be conduct- ed, consistent financial customers' protection institution, multiple financial disputes handling mechanism with the emphasis on fmancial ADR must be constructed, financial market constraining mechanism must be perfected, and moral hazards possibly caused by averting financial customers' protection.
