摘　　要： 文章认为秦简《法律答问》并非具有法律效力的官方法律解释,而是一部法律实务题集。《法律答问》中的"廷行事"也并非成例或判例,而是官府惯例。《法律答问》中的比也并非决事比,而是类推之意。《法律答问》的内涵并非只限于所谓《法经》六篇,而是具有与出土秦汉律篇相一致的内容。《法律答问》是学吏制度的产物,是法律实务教本。 The author shows Fa Lv Da Wen is a law practice question set but not the official legal interpretation in this paper, in which the judicial examples are the official judicial routines not the judicial cases, and the Bi includes analogy meaning but not according to the cases in this book, and the content of those Qin slips not only includes Fa Jing Liu Pian but also the same content with the law articles of Qin and Han Dynasties. It is the product of bureaucratic system and a law practice textbook.
