摘　　要： 司法机关对其违法司法行为承担司法责任符合法理、法律、法治现状及市场经济的内在要求 ;司法责任具有行为主体的专属性、导因的违法性、道义的否定性及谴责性等特点 ;建立司法责任制度可以监督和促使司法机关依法司法 ,保护广大人民的合法权益 ,维护社会主义法治尊严 。 Judicial authority taking judicial responsibility over its illegal judicial act is in accordance with legal principles,with the law,with present situation of goverment by law,and also meets the demands of market economy;Judicial responsibility has such characteristics as the exclusiveness of action subject,cause violation of the law,the negativeness and denouncement of moral principles;the establishment of legal responsibility system may supervise and precipitate the judicial office to administrate the justice according to the law,thus safeguard the legal rights of common people,Vindicate the sancity of socialist goverment by law and precipitate the development of socidist goverment by law.
