摘　　要： 刑法解释论对紧急避险法律性质的探寻,离不开规范的价值基础和刑法的相关规定。紧急避险原则上应当被视为违法阻却事由。从行为价值和结果价值相结合的立场出发,应当否定损害利益与保护利益相等的避险行为对行为违法性的阻却。以行为规范和裁判规范的二分为前提,在与《刑法》第16条的规定相关联的意义上,可以在一定范围内承认阻却责任的紧急避险行为。 The discussion of legal nature of necessity should base on the standard of value and legisla- tion. Necessity mainly should be considered as the exemption of illegality. From the standpoint of the combination of value of behavior and result, necessity that damages the interests and protects the interests equally, should be considered illegal. From the premise of code of conduct and the standard of judgment, and associated with the sixteenth provision of criminal law, necessity in a certain range can be admitted.
