摘　　要： 一个国家的权力结构决定着其治理类型,当一个国家是集权格局、权力缺乏制衡时,其往往会走向基于关系型合约的社会治理型态;而当一个国家是分权格局、权力得到有效制衡时,其往往会走向基于规则型合约的社会治理型态。从中国几千年以来的权力结构变化和社会型态变迁的历史中,可以清晰地看到权力结构对一国社会型态的深刻影响。鉴于此,中国要走向规则型社会,就需要改变现有的权力结构,依靠分权和制衡来抑制关系型合约的滥用,促进规则型合约治理的发展。 The power structure of a country determines its governance type. When a country is of the centralized pattern and its power is out of balance, it always gets to the social governance type based on the relational contracts. And when a country is of the decentralized pattern and the power is effectively balanced, it always gets to the social governance type based on the rule contracts. From the Chinese history of power structure change and social patterns change over thousands of years, it can be seen clearly that the power structure has a deep influence on the he country＇s social type. In view of this, if China is going to be a rule contracts country, it should change the existing power structure by relying on the decentralization and balances of power to suppress the abuse of relational contract, and promote the development of the rules contract.
