摘 要: 跨国经济法的某些领域(以国际商事仲裁和WTO体制为典型例证)存在若干所谓"美国化"的表征;跨国经济法"美国化"是全球化进程中美国以经济实力为依靠推行其文化霸权的一个侧面,这种推行一方面是美国有意识地主动而为之,也有他国及其私法主体主动接纳的成分;其本质是美国的"软权力"在那些与主权国家的民族、宗教、文化传统联系相对较小的法律领域所施加的作为动态进程的影响。 The author tries to demonstrate that there do exist some tokens of so-called Americanization in the domain of transnational economics law with two typical examples,one being international commercial arbitration,the other being the WTO system.This paper argues that Americanization of transnational economics law is just but one aspect of US's pursuing cultural hegemony by economic strength in the course of globalization;this sort of pursuit has been done intentionally by the US on one hand,and the other nations and their private subjects' voluntary adoption on the other.The essence of Americanization of transnational economic law is the influence of US' s soft power,as a dynamic process,over those legal areas which have less connections with sovereign states' nationality,religion and cultural tradition.
