摘 要: 我国信访制度的功能经历了从权力控制、群众政治参与到权利救济三个阶段的变化。现行的信访制度是中国共产党群众路线的产物,是具有典型时代特点的便宜设计,然而,传统的社会心理因素在该制度实践中仍然起着关键的作用。当前,信访制度本身正面临法治化的挑战,其出路在于改变传统的权力纵向控制方式,建立以权力互相制约为基础的扁平化的治理模式,使信访制度回归到辅助性的地位。 China's complaint reporting system has experienced an evolution from power control, political partici- pation of civilians to right remedy. The current system of complaint reporting is a typical invention of the time by Communist Party of China to implement its "mass line". However, the conventional sociological and psychologi- cal factors still play a part in the practice of the system today. At present, the system must be put on a more sol- id legal footing and its way out lies in the change of traditional and vertical mode of power control. A flat man- agement mode must be introduced into the supervision of power, so that the complaint reporting system would re- gain its auxiliary function.
