摘　　要： 以女性主义理论和学术的核心——社会性别为基础来构建独有的反思视角,以此可以审视作为环境法基本价值的环境正义。现有的环境正义价值强调了种族间、区域间的正义,却忽略了作为重要分析范畴的社会性别的意义。文章在分析社会性别视角下环境正义价值的迷思后,展望了环境正义价值的新图景:强调性别环境正义;将差异平等作为标尺;实现从关怀伦理到关怀价值的转化;将公共/私人领域作为同时适用的场所。 Gender has become a fundamental concept of feminist theory. The paper employs it as new and useful perspective to rethink environmental justice, which is the pivotal value of environmental law. The common sense of environmental justice in current literature emphasizes more on regional or ethnical discrepancies. However, the importance of gender as an analytical category has been ignored. After exploring the mysteries of environmental justice under gender perspective, the paper envisage the new scenario of environmental justice which emphasizes gender environmental justice, uses differentiated equality as a standard, stimulates the transition from care ethnic to care value, and applies in both public and private domain.
