摘 要: 《食品安全法》的产品责任规定是社会转型期食品安全事故高发背景下的产物,对于缘起于《民法通则》、历经《产品质量法》、《消费者权益保护法》等法律的我国以往产品责任立法有诸多突破,在其之后《侵权责任法》又有了新的发展。这使得在产品责任个案中可能会产生法律适用上的冲突,如惩罚性赔偿规定的冲突、损害赔偿范围规定的冲突。解决这些冲突,首先要依据不同的请求权基础确定适用的法律规则;其次,可依据《立法法》第83条规定的特别法优于一般法、新法优于旧法的冲突规则确定具体适用的法律规则。 Provisions of product liability are inserted into Food Safety Law because of the large number of food safety accidents in the social transition period. Compared with the original provisions of product liability of General Rules of Civil Law, which are improved by Product Quality Law and Law on Protection of Consumer Rights and Interests, those of Food Safety Law become a new breakthrough. Different provisions of different laws may cause the conflicts of law application in the individual cases, such as the conflicts of punitive damages and conflicts of extent of compensation for damages. To solve these conflicts, firstly, application of law should be determined by different rights of claim. Secondly, application of law may be decided according to Article 83 of Legislation Law, which provides that special law and new law prevail where inconsistency of law exists.
