摘　　要： "搭顺风车"、"拼车"等善意搭乘行为,已经成为越来越多的人出行的首选方式。善意搭乘既非法律行为又非事实行为,而是游离于法律规范之外的情谊行为,应由道德来调整。但是驾驶者违反注意义务导致搭乘者人身或财产遭受严重损害,则应承担法律意义上的赔偿责任。损害赔偿应采用以过错责任为主、以公平原则为辅的归责原则,并辅以相应的保险制度,以求妥善解决绿色出行问题。 ＂Free ride＂ or ＂hiring a car together＂ has become an increasingly preferred method for travelling. The goodwill ride is neither a lawful nor a factual behaviour, it is a friendly behaviour beyond the law norms that should be adjusted by morality. If it is the driver＇s negligence that causes damage to the passenger, this behaviour constitutes infringement and the driver should bear the legal liability. In order to solve such problems, damage compensation should be based mainly on fault liability, sup plemented by the principle of fairness and corresponding insurance system.
