摘　　要： 基层派出所警察在流动人口的社会控制中起着重要作用,观察其在法律运行中的作为,分析其价值判断的标准为何,有助于厘清和反思刑事法律的价值理念。解决纠纷与保障安全是警察在实践空间内的首要考虑。影响警察价值判断的因素有个人也有社会的,要减弱当中消极因素的影响,不仅要诘问行使权力者,还需要社会的自我反省。案件处理过程中和结果存在的差异是安全和平等等价值博弈的产物。流动人口并不比其他群体更具有人身危险性。 Police working in grass-root police stations plays an important role in social control of migrating population. Knowing what they do and how they do in this process is helpful to reflect the values of law. Resolving the dispute and securing the security is the paramount consideration for police. Factors which can affect police value judgment could be both personal and social. To weaken the influence of negative factors, we should not only turn to the exercise of powers but also need to do self reflection. The difference between the processing procedure of cases and the results of the cases is the product of the game among the values of safety and equality. Migrating population, as part of the society, is not more dangerous than other groups.
