摘　　要： 目前,越来越多的商业标志所有人在缺乏专门法律保护的情况下,都选择以未注册商标的形式请求法律保护。因而,有必要讨论"成为和保护"未注册商标的条件。严格意义上的未注册商标应符合注册商标的法定条件。对于有可能成为未注册商标的商业标识,要有特殊的判断标准。不是一经成为未注册商标就能受到具体的法律保护。未注册商标的法律保护需要满足相应的条件。 Presently, more and more commercial mark owners choose to be in the channel of unregistered trademark when claiming legal protection in the case of absent special legal protection in China, which makes it necessary to discuss the licensing of an unregistered trademark and its protection. An unregistered trademark will coincide with the legitimate requirements in exact sense. There must be special gauges for those commercial marks possibly to be an unregistered trademark. An unregistered trademark can not obtain legal protection unless it meets the relevant requirements of.
