摘　　要： 网络中介服务提供者,在传播信息的过程中提供信息交流中介服务,处于传播者的法律地位,应当对其责任进行适当限制,为其提供"避风港"的保护。腾讯在提供即时通信服务过程中属于信息的传播者,不享有信息内容的审查监控权,对于用户发布的相约自杀的侵权信息主观上无过错,不负报告义务,腾讯作为网络中介服务提供者不应承担责任。 Internet Service Provider（ISP）provides intermediary information exchange service. In the process of dissemination of information, ISP is in the legal status of the information communicators, whose responsibility should be limited appropriately and haven protection should also be provided. While providing instant communication service process, Tencent is an information communicator without any right to monitor information. Therefore, it had no fault with regard to the user＇s releasing the suicide pact information. Bearing no reporting obligations, Tencent as an ISP should not assume any responsibility or liability.
