摘 要: 在西方政治思想史上,马克斯·韦伯第一次对政治合法性问题进行了系统研究并使之成为经典理论。韦伯合法性关注的首要问题是统治者如何统治,而不是统治者为何统治。权威与服从,是一种政治现实,而非价值判断。合法性基础可分为三种:对传统的遵从、对超凡魅力的信服和对理性的追随。唯有法理型统治才体现了历史发展的潮流,是政治发展的必然结果。韦伯的合法性理论极富开创性,但抽去了规范主义合法性理论的价值反思内核,表现出明显的技术化、工具化倾向。 In the history of Western political thought, Max Weber systematic studied the question of political legitimacy for the first time and made it a classical theory. Weber~ thought of legitimacy primary concern was how the rulers to rule the people, rather than why the rulers to rule the people. Authority and obedience is a political reality and is not a value judg- ments. The basis of legitimacy can be divided into three types : following the traditional, the conviction of Charisma, and fol- lowing the reason. Only the legal - rule exemplifies the trend of historical development. It is the inevitable result of political development. Weberg theory of legitimacy is very groundbreaking, but it takes away the core of value of the normative legal theory, showing a significant technical and tool orientation.
