摘　　要： 知识产权犯罪中,犯罪数额对定罪量刑至关重要。认定数额的标准可分为:销售金额、违法所得数额、非法经营数额、涉案物品数量、损失数额等。现有法律与司法解释未明确损失数额的具体内涵和计算方法。侵犯知识产权犯罪数额犯存在犯罪未遂形态。完善犯罪数额认定标准,可增加"权利人经济损失"、"侵权品的制售数量"作为定罪量刑的标准。 In intellectual property rights infringement crime, the amount of crime plays an important role in conviction and sentence. The classification standards of amount include, sales amount, illegal income amount, illegal business amount, the number of items involved, loss, etc. However, the current crimi- nal law and judicial interpretation have not clarified the specific content and calculation of amount of crime. The intellectual property crime contains unaccomplished states. It is necessary to improve the standards of identifying the amount of crime by adding such items as the economic loss of rights and the amount of infringing goods produced and sold.
