摘　　要： 对动物能否拥有"权利"这一问题的回答,在很大程度上取决于对"权利"概念本身的理解:把权利理解为主体自由选择的能力还是理解为生命生存的能力。而对权利概念的不同理解基于人类生活世界的历史性变迁,在生态危机已经威胁到人类社会乃至整个自然生态系统存在的时代背景下,赋予动物以正式的法律权利不是不可思议的天方夜谭,而是挽救地球文明的一大进步。 The answer to the question ＂could animal have rights＂ is decided by our understanding of the concept ＂right＂ itself： the right is an ability of subjective liberal choice or an ability of life＇s living. The different understandings of the right are based on the historical changes of the society. When the ecological crisis has threatened human societies and the whole natural ecological system, the legal rights should be vested to the animals. This is not an unimaginable illusion but a huge development of the earth civilization.
