摘 要: 近些年来,我国的劳动争议案件逐年递升且处理难度日趋加剧、社会影响力不断扩大,现行的劳动争议处理制度不尽完善难以适应现实需要,劳动争议案件得不到及时、有效的处理,不利于劳动者合法权益的保护,也给社会的和谐发展带来负面影响。本文在认识我国现行劳动争议处理体制主要特点的基础上,从对我国现行体制存在缺陷的分析入手,提出适合我国国情和现实情况的劳动争议处理新体制——双轨制模式,并提议进行一系列的改革,使新体制的作用得以发挥。 In recent years,the number of labor disputes has been ascending yearly and the difficulty in handling is increasing together with the social impact expanding.But the current system of dealing with labor disputes isn't sufficient to adapt to practical needs.As a result,the labor dispute cases haven't been handled timely and effectively,which is not conducive to the protection of the legitimate rights and interests of laborers,and also bring negative impacts to the harmonious development of society.Based on an analysis of the main characteristics and deficiencies of the current system,this article puts forward a new system,i.e.double track system that may suit to China's national conditions and current situation,and proposes a series of reforms that may play a more positive role.
