摘　　要： 如何认定违反法律、行政法规强制性规定的无效合同,在处理合同纠纷的实务操作中至为重要。准确适用法律、行政法规的强制性规定是认定无效合同的关键;就无效合同的判定而言,签订合同和履行合同不应一概而论;合同无效时,过错方的赔偿责任仍应依法承担。 How to identify the invalid contract is very important in the practical operation of processing contract disputes.Proper application of the laws and some mandatory provisions of administrative regulations are the key to it.Contract signing and contract performing should be treated differently in the identification of invalid contracts and the party in default should bear the liability to pay compensation.
