摘　　要： 利用影响力受贿罪增设的意义主要在于适应打击当前贿赂犯罪以及诉讼证明的现实需要。"利用影响力"既是本罪的本质特征,也是理解本罪客观行为结构的重点。同时,"关系密切人"是理解和认定本罪行为主体的关键。此外,在界定本罪中相关人员刑事责任问题上需要具体分析,区别对待。 The significance of the newly-added bribery crime committed with personal influencing power lies in attacking current bribing crimes as well as lawsuit proof. Using influence is not only the essential characteristic of this crime, but also the focus of understanding its objective behavior structure. Meanwhile, the person of close relationship is the key in understanding and identifying the behavior subject of this crime. It needs concrete analysis and different dealings in defining criminal responsibility of the related people.
