摘　　要： 从政策、政府职能、融资环境和法制环境4个方面对外出务工农民回乡创业正式制度环境进行研究。为了引导外出务工农民回乡创业,在政策方面,应消除所有制歧视,扩大财政支出,调整税收制度,完善社会保障制度;在政府职能方面,应加强产业引导,建立回乡创业组织化制度,塑造回乡创业型企业品牌形象;在融资环境方面,应强化银行向回乡创业者贷款的激励机制,完善为回乡创业企业服务的金融组织体系,完善回乡创业企业信用担保体系;在法制环境方面,应加快相关立法步伐,公正、公平与公开地执行法律。 The formal institutional environment for the peasant migrant workers returning to hometown to establish businesses is analyzed from the four aspects of policy and economy, government functions, financing environment and legal environment. In the aspect of policy and economy, it is necessary to eradicate ownership discrimination, expand financial expenditures, adjust taxation systems, improve social security system; In the aspects of government functions, it is necessary to strengthen industrial guidance, establish systems for returning-home businesses, create enterprise brand for returning-home businesses; In financing aspects, it is necessary to strengthen incentive mechanism for banks to loan to home-returning business starters, improve financial organization system to provide services to returning-home businesses, and establish improved credit guarantee systems; and in the aspect of legal environment, it is necessary to speed up the related legislation to make sure that the laws are executed justly, fairly and openly.
