摘　　要： 当前,研究法律文化的学者们一般将中西传统诉讼观念划分为无讼型诉讼观念和好讼型诉讼观念两种,从而进行研究比较。他们的研究大都着重于比较二者的区别和差异,而忽略了比较二者的相同之处。实际上,中西传统诉讼观念在几千年的文化和历史发展中,在某些特定历史时期和地区中也是存在着一些暗合的。 Presently,most scholars who study legal culture,classifies Chinese and western litigation conceptions into two types,no-lawsuit-proceeding and immediate-lawsuit-proceeding.Their studies focus on the differences between the two,while ignoring the similarities.As a matter of fact,there exist implied similarities between Chinese and western legal conceptions in certain periods of time and places in historical development during thousands of years.
