摘　　要： 近年来，现代学校制度逐渐成为政府和教育界极为关注的热点话题。然而，在构建和设计现代学校制度的过程中，教育市场化和教育产业化的影响十分严重。多数学者以经济制度的眼光来看待现代学校制度，认为应以产权明晰和法人治理为其核心价值，这是当今普遍存在的一种观点，也是学界的一种主流观点。但教育的公正性应成为现代学校制度的核心价值；坚持这种价值取向，具有极其重要的理论价值和实践意义。 The institution of modem school is the extreme concemed matter by government department and educational circles in recent years, in the process of constructing and designing this school institution, education mercerization or education industrialization phenomenon influences more seriously, many people regard the institution of school as the economic institution, and think should take property right and legal person and so on as its core value content, which is one viewpoint that now generally exists, also is one kind of mainstream viewpoint in the educational circles. This article actually has the different view, it think the education justice should become the core value of the institution modem school, persisting this kind of orientation that has the vital significance. Therefore, this article has made some discussions on the modem school institution value orientation for our current this institution construction.
