摘 要: 未将常雇型劳务派遣与登录型劳务派遣进行分类规范是目前我国劳务派遣立法和实践混乱的根本原因。常雇型劳务派遣与登录型劳务派遣运行机制不同,两者对经济社会发展、劳动者利益保护、社会就业影响差异较大,分类立法可能是目前解决劳务派遣立法和实践混乱的较好的方法。 The confusion of legislation and practice of the labor dispatch in China results from the fact that the labor dispatch is not distinguished from' often employment' and 'register employment'. With the different operating mechanism 'often employment' and 'register employment' have a great different impact on the economic and social development, protection of the workers' interests and employment. The separate legislation to the 'often employment' and 'register employment' can solve these problems at present.
