摘　　要： 石油石化企业的职务犯罪呈现出主体的特殊性、犯罪行为与职务的关联性、明显的行业性等特征,其犯罪根源与低犯罪成本的法律环境、市场经济制度不完善、错位的权力观等相关,石油石化企业职务犯罪体现为从位高权重者到基层职员均染指职务犯罪,个案带出片案、群案,家族共同犯罪频发。因此,必须正视石油石化企业在预防和打击职务犯罪上的特殊性,在思想道德上、经营管理等方面予以防范,加强法律能力建设,严格掌握法律知识和政策界限。 Duty crimes in petroleum and petrochemical enterprises are of special subject,of relevance of the criminal behavior and post,and of significant profession.The causes of this crime involve the low cost of crime,the imperfect market economy system,dislocation of power,etc.People in different posts are involved in the duty crimes in petroleum and petrochemical enterprises.It is frequent that the family members commit together.Therefore,we must take some measures on the ethical and business management to prevent this type of crime,and to strengthen the legal capacity building,know about the distinction between law and policy.
