摘　　要： 我国无独立请求权第三人制度的立法规定存在许多缺陷,主要表现是,无独立请求权第三人的诉讼地位不明确,参诉依据具有模糊性,参诉方式存在被动性。无独立请求权第三人制度存在诸多问题的根本原因是无独立请求权第三人的诉讼权利缺乏程序保障。保障无独立请求权第三人的诉讼权利并建立辅助参加制度应当是无独立请求权第三人制度改革的基本方向。 There exist many defects in the legislative stipulation of the system of the third party without independent claim in our country, whose main manifestations are the procedure status of the third party without independent claim is indeterminate, the legal basis of the third party without independent claim joining procedure is not clear, the way which the third party without independent claim join litigation has passivity. The basic reason why the system of the third party without independent claim exist many problems is that the lawsuit right of the third party without independent claim lacks procedural guarantee. To ensure the lawsuit right of the third party without independent claim and establish the system of the auxiliary intervention shall be the basic direction reforming the system of the third party without independent claim.
