摘　　要： 随着我国现代交通事业的发展,道路交通秩序也越来越重要。我国目前交通事故频发,造成的人员伤亡和经济损失惨重,交通安全的现状令人担忧。面对严峻的交通安全形势,我国的刑事对策还存在一定的缺陷和不足,主要表现为交通犯罪的罪名单一,没有形成对交通秩序的立体保护,法定刑偏低,对于一些重大的、恶性的交通犯罪案件无法做到罪刑相适应,司法实践中对交通犯罪案件也存在过于从宽的办案指导思想。为了完善交通犯罪的刑事对策,必须增加新的罪名,同时注意宽严相济刑事政策的运用,注重对交通犯罪人的教育改造以实现特殊预防。 With the developmenet of modern transport in china,road traffic order has also become increasingly important. The situation of traffic safety is worrying with the happening frequency and the great damage to people and economy. Facing such severer situation,our criminal measures are quite inadequate,without enough charges with traffie offenses, overall protection for traffic oredr ,strong legal punishment,proper penalty to some major malignant traffic crimes and appropriate guideline in hardling such eases in judicial practice. To improve and perfect countermeasures against traffic offenses,we should add new charges with traffic crimes,pay attewtion to proper application of criminal policies and place more weight on the edueation for offenders so as to special prevention.
