摘　　要： 民族民间文艺的知识产权保护是一个历久弥新的法律课题。世界各国及国际组织半个世纪以来的各种法律成果,在取得若干经验的同时,在民族民间文艺范围、立法目的、基本原则、主要规则等方面依然存在诸多问题。文章提出,应把不具有知识产权意义的事项、具有"准工业产权意义"的事项、民族民间文艺衍生作品的创造性部分、"思想"等公共领域要素排出保护范围;应把保护民族民间文艺的知识产权和民族民间文艺的文化价值确定为民族民间文艺保护制度的立法目的;把激励创新原则、利益平衡原则、二分法原则、集体性原则、传统性原则确定为民族民间文艺保护制度的基本原则;把有关少数民族或其村寨确定为民族民间文艺的权利主体;将独创性、集体性、传统性确定为民族民间文艺的保护标准;务虚与务实相结合,确定民族民间文艺的权利内容与保护期限。 The protection of intellectual property of ethnic folk literature and art,as a legal topic,has been studied for a long time but still a new question to some extent. Past half century,many nations and international organization have gotten mounts of legal achievement. But there are still many unsolved questions like the boundary of ethnic folk literature and art,legislative purpose,fundamental principles,main rules etc. This paper argues that the legal matters which do not belong to intellectual property right,the legal matters which have approximate industrial property right,the creative parts which derive from the works of ethnic folk literature and art,and the legal elements which are in the public domain like 'thinking' should be excluded from the protection of intellectual property of ethnic folk literature and art. The legislative purpose of the protection of ethnic folk literature and art in institution is to protect its intellectual property and cultural value. The fundamental legislative principles of it in institution are the principle of innovation,balance of different interests,dichotomy,collectivity,and traditionality. The subjects of the rights of it are concerning ethnic minority groups or villages. The criteria of the protection of it are innovation,collectivity and traditionality. Through the combination of theoretical principles and reality,the boundary and period of protection will be determined.
