摘　　要： 美国私立营利性高校是融合了企业和学术机构特点的独特机构。其既要根据公司法和税法的规定接受来自政府企业管理机构的管理监督,又通过间接获得经费资助、接受认证管理和行政管理等受制于联邦和州政府教育管理机构的管理监督。借鉴美国的经验,我国在法律层面也应对私立高校作出营利和非营利之分,建立中介机构,协调政府与民办高校的关系,建立面向所有学生的资助体系。 The for-profit private higher education institution in America is the unique institution that integrated the characteristics of enterprise and academic institutions.In one aspect,it should accept the management and monitoring of governmental enterprise management institutions according to the regulations of corporation law and tax law;on the other aspect,it should accept the management and monitoring of educational management institutions of federal and state government through obtaining financial help,accepting authentication management and administration management.Referring American experiences,China should differentiate for-profit and non-for-profit higher education institutions on the level of law,build medial agency to harmonize the relationship between government and non-governmental higher education institutions and build the imburse system facing to all students.
