摘　　要： 《档案法》第二轮修改在立法理念及《档案法》的宗旨定位上将明显有别于第一轮修改。修改的重点应该围绕移植《政府信息公开条例》所确立的"公开是原则,保密是例外"的立法精神、电子文件如何"入法"、如何从立法技术上保证档案行政执法工作有效开展等问题展开。本文提出修改《档案法》时要借鉴国外档案立法的成功经验,选择适合于我国国情的立法模式。 The legislative idea and the aim location of the second round amendment of Archives Law is signifi- cantly deferent from the first round amendment. The emphasis of the amendment should center around the following issues： transplanting the legislative spirit of ＂openness is the tion＂ established by the Regulation on the Disclosure of Government principle and confidentiality is the excep＂ Information; how to write in the electronic records to the law; how to ensure the effective development of archives administrative law enforcement in terms of legislative technology; etc. The report also proposes that the successful foreign experiences be used and the legislative models according with the situation of our country be selected.
