摘　　要： 业主与物业管理企业的关系体现在前期物业服务合同和物业服务合同两个阶段。通过经济分析,两者在前期物业服务合同阶段表现为竞争关系,如何保护业主合法权益成为焦点。在物业服务阶段,两者的合作关系占主导地位。双方通过效率式合同可以达到双赢局面。 The relationship of owners and realty service enterprise is in prophase realty service contract and realty service contract. Through the economic analysis,owners and realty service enterprise are relation of competition in prophase realty service contract. It is a focus to protect the owners＇ lawful rights and interests. The cooperative relation of owners and realty service enterprise is dominant in realty service contract. Both owners and realty service enterprise are to gain profit at the same time when they are in an efficiency branch of contract.
