摘　　要： TRIPS协议第31条关于专利强制许可的规定实际上是给WTO各成员方实践强制许可设置了过多障碍,尤其是要求强制许可应主要供应国内市场的需要,给发展中国家和最不发达国家解决公共健康危机造成了极大的困难。并指出TRIPS协议专利强制许可制度的最新发展及其对解决公共健康危机的作用。同时,阐述了TRIPS协议之修订对我国专利强制许可立法的影响,促进了我国专利强制许可制度的发展和完善。 This paper first analyzes the 31st Article of the TRIPS Agreement concerning the compulsory licensing for patent. It points out that the WTO has placed many obstacles to its members in implementing the compulsory licensing, which has made the solving of public health crisis extremely difficult in the developing countries and the least developed countries. Then, it introduces the latest development of the regulations on the compulsory licensing for patent in the TRIPS Agreement. At last, it evaluates the impact of the revise of the TRIPS Agreement on the legislation of the compulsory licensing for patent in China. The research results will promote the development and perfection of the compulsory licensing policy for patent in China.
