摘　　要： 《生物多样性公约》建构了以遗传资源利益分享权为支点的遗传资源财产权。基于《生物多样性公约》的遗传资源财产权,内蕴着从遗传资源所有权递进到遗传资源特别财产权利的法律逻辑,隐藏着遗传资源所有权和遗传资源特别财产权利的内涵。遗传资源特别财产权利,为我国制定遗传资源(财产权)保护法提供了理论支持,为生物多样性和生态安全提供了私权保障。 The Convention on Biological Diversity has developed genetic resources property rights based on the benefit-sharing rights of genetic resources.The genetic resources property rights on the Convention on Biological Diversity evolved from the ownership of genetic resources to the sui generis rights on genetic resources.The sui generis rights on genetic resources theoretically support us in formulation of the law to protect genetic resources.This new sui generis property rights safeguard biodiversity and biological safety from the private rights.
