摘　　要： 我国彩票市场刚刚建立,但对相应犯罪行为的刑法规制却付之阙如。各国和地区关于彩票犯罪的规定和实践各具特色,尤其是德国刑法中的彩票犯罪的立法和解释,为我们提供了有益的经验。我国刑法有必要增设相关彩票犯罪,进行刑法规制的整体配置。 The lottery market in China has just come into existence, and the criminal laws and punishment concerning this kind of crime is still wanting. Lottery crimes are punished by specific laws, regulations, and practices in many countries and regions, especially the legislation and interpretation of lottery crimes in Germany has provided us with useful experiences. It is necessary to construct an overall configuration of legislative system on lottery crimes in our criminal law on the basis of the study of these experiences.
