摘 要: 我国工会组织的一元化和雇主组织多元化的现状客观上背离了劳资组织权对等的法律原则,在金融危机肆虐、劳资关系紧张之时,上述不利于劳动权保护的制度缺失更为凸显。为保证我国缺乏谈判能力的低薪工人的经济利益,必须对其提供倾斜性法律保护,并为这些倾斜性权利的实现积极创造条件。为此,应结合我国具体国情,创新全球化进程中劳动权保护的模式和政策,推动我国和谐劳资关系的构建。 The present situation of the centralization of labor union organizations and the pluralization of employers' organizations goes against the legal principles of reciprocity of rights to organizations between labor and capital. In times of financial crisis and tense relationship between labor and capital, the lack of labor rights protection system is more prominent. To ensure under-paid workers who lack the ability of negotiation of economic interests, legal protection which inclines to these workers must be provided. Meanwhile we should create favorable conditions to realize these inclining rights. To achieve this, we should create new modes and policies protecting labor rights based on the concrete situations of our country in the process of globalization, promote the construction of a harmonious labor and capital relationship of our country.
