摘　　要： 探讨与金融危机相关的法制问题以及应对措施,是法学研究的理论前沿之一和金融法制建设的重要方面。当下金融危机揭示出金融监管的法制缺位问题,金融危机管理法的建构、发展和完善过程,与金融危机的爆发和应对密切相关,大体上经历了"初步管制—严格管制—放松管制—收紧管制"的发展历程,其宗旨在于维系金融安全,其实质为金融风险管理与危机对策法。有鉴于此,应从制定专门的《金融危机管理法》、推进统一的《金融业监督管理法》以及建立和完善存款保险制度三个主要方面,构建和完善我国相关金融危机管理法律制度。 To explore the legal problems and the countermeasures relevant to the financial crisis management is an important aspect of building the financial legal system and researching one of the theoretical frontiers. The present financial crisis reveals that there lacks a legal regulation system. To build, develop, and perfect the laws of the financial crisis management is therefore closely related to the outburst and solution of financial crisis. This process is roughly divided into four procedures： ＂initial regulation, strict regulation, de--regulation, and fastening regulation＂. The goal is to maintain the financial security, and the essence is to better the financial crisis management and the crisis countermeasures. It should therefore for mulate the professional financial crisis management laws, advance unified financial regulation and supervision laws, and con struct and perfect the deposit assurance system.
