摘　　要： 环境法治建设是我国依法治国的重要组成部分之一,而环境法治的重点就是要综合运用各种法律手段,调控、协调人与人以及人与自然的关系。环境法治建设的基本路径不应只局限于环境立法、环境执法与守法的互动协调,更应从环境法的"善治"路径、环境法治的"控-导"路径、环境法治的软(法)硬(法)兼施路径、环境行政权三分路径、环境实质法治路径等方面展开。同时,还应关注与总结我国环境法治的规律,核心是以我国的国情为基础,协调好中央与地方的关系以及环境管理与公众参与的关系,充分落实科学发展观,实现经济发展与环境保护的"共赢"。 Environmental Law-governing Construction is an important part of running the whole country according to the law,guided by the scientific concept of development,this paper is focus on how to explore the way of environmental law-governing,in response to the themes of present era which is people living in harmony with nature.The emphases of environmental law-governing is comprehensively using various legal measures,regulating and adjusting the relationship between people,people and nature.The elementary way of shall not be limited in harmonizing the environmental legislation,environmental law enforcement,and compliance with the law,shall start with the ways of environmental law＂good governance＂,the environmental law-governing ＂control-restrict＂,combined approach of sofe（law） and hard（law）,the executive power divides into three parts,essential environmental law-governing and so on.Simultaneously,shall pay attention and summarize the rules of environmental law-governing of China,the essence is basis on the specific conditions of our country,harmonize the relationship between the central and the local,environmental administration and public participation.This paper comprehensively use research methods such as comparison and demonstration,learn from research methods of other sciences to explore the ways to construct environmental law-governing of our country.The conclusion： Chinese environmental law-governing construction shall fully response to people living in harmony with nature,contribute to the harmonization of economic development and environment protection.
