摘　　要： 善意取得制度是民法上一个具有长久学术魅力的制度,我国物权法的出台将善意取得制度中的核心问题善意取得制度的一般规定立法化,并将善意取得的范围扩大至不动产。毫无疑问,这是我国立法上一个非常大的突破和进步。但是,由于立法者比较注重法律制度的简洁,将动产善意取得和不动产善意取得进行统一规定,这就使得这一制度尚有一些需要详细讨论的问题。 Innocent Purchase System is a system which has a forever charming for the scholars in the Civil Law.In our Property Law the system＇s core question,the. Innocent Purchase System＇s common stipulation,is legislated,and widen its spectacle to the real estate .Undoubtedly,it is a big progress and outbreak in our law-making.But the law-makers put focus on the concise of the law system and try to integrate the movable and the real estate,which makes the system still have something to discuss carefully.
